On Friday, July 25, Mario Guevara’s lawyers shared important updates regarding the case of the Salvadoran journalist.
The information was broadcast live from Mario Guevara News’ official Facebook page.
Giovanni Díaz, Guevara’s legal representative and partner at the law firm Díaz y Gaeta, addressed the most urgent questions.
During the broadcast, the lawyer explained the complex legal situation preventing the journalist’s release.
The Arrest of the Salvadoran Journalist

Mario Guevara was arrested on June 14 while covering the “No Kings” protest in Georgia.
Although he was granted bail in his immigration process, new legal restrictions have prevented his release.

The case has sparked outrage among family members, colleagues, and press freedom organizations.
Amid growing concern, the lawyers decided to provide details about the legal hurdles the journalist is facing.
Mario Guevara’s Lawyer Breaks the Silence
“The Immigration Law, regarding bail, has decided that all people who are detained after entering the country without permission—regardless of whether they have lived here for one, ten, or forty years—are not eligible for bail,” Díaz explained.
The lawyer pointed out that this change in policy represents a break from more than two decades of legal interpretation.
“The sad part is that, although the law clearly allowed for bail for over 20 years—according to not only lawyers but also the prosecution and the Court of Appeals—people who entered without permission and have lived here for some time qualified for bail,” he added.
Díaz warned that many immigration judges are accepting this new stance, leaving thousands of immigrants without legal recourse.
Immigration Law Complicates His Release
“What’s concerning is that immigration judges are accepting this, and some are saying there’s no remedy,” he stated.
In his remarks, he also denounced that this policy affects people who have built lives in the country.
“They are punishing hardworking people, Christians, business owners, who have no criminal records,” he emphasized firmly.
For the lawyer, this situation is part of a broader government strategy that will eventually be challenged in federal courts.
Ongoing Legal Actions by His Defense Team
Despite the obstacles, Díaz confirmed that several legal actions have been filed on Guevara’s behalf.
“We have submitted three petitions to the Court of Appeals, we have his Immigration Court case, and the most urgent matter is the bail,” he explained.
He emphasized that all charges against the journalist have already been dismissed, so he does not pose a danger to the community.
“Clearly, he is not a risk to the community nor a danger,” the lawyer stated regarding Guevara’s situation.
Court of Appeals Initiates the Process
One of the most encouraging developments was the notification from the Court of Appeals to submit the legal brief.
“They have already sent us the dates to submit what is called the legal brief, and that shows us they want to resolve this as soon as possible,” said Díaz.
Although legal timelines can extend for weeks or months, the law firm Díaz y Gaeta remains hopeful for a favorable resolution.
The lawyers emphasized that the priority is to lift the order blocking the payment of the already authorized bail. This would allow Mario Guevara’s prompt release while the merits of his immigration case are resolved.
Growing Support and Rising Expectations
Within the journalist’s close circle, concern prevails but so does constant support for his cause. The case has once again brought the debate about the treatment of immigrant journalists in the United States to the forefront.
Human rights advocates have highlighted how these policies affect freedom of expression.
More details about the process and next steps are expected from the legal team in the coming days. The Salvadoran community in the U.S. and numerous organizations have shown their support for Guevara since the start of his detention.
For now, the focus remains on the Court of Appeals and the impact its decision may have on the outcome of this case. The legal team assures that they will continue fighting for the journalist’s release and the respect of his constitutional rights.
