The investigation into the killing of conservative activist Charlie Kirk entered a crucial phase on Monday with the start of the preliminary hearing for 23-year-old Tyler Robinson, who is charged in the case.

The hearing, held in a Provo, Utah, courtroom, was marked by tense moments, the presentation of sensitive audiovisual evidence, and the first face-to-face encounter between Kirk’s family and the defendant since the fatal shooting.

Charlie Kirk Murder Case Reaches a Critical Stage

The purpose of the preliminary hearing is to determine whether prosecutors have presented enough evidence for Robinson to stand trial on an aggravated murder charge.

If the case proceeds and Robinson is ultimately convicted, he could face the death penalty under Utah law.

The hearing began under heightened security due to the high-profile nature of the case and the widespread national attention it has received.

Before members of the public and the media entered the courtroom, Robinson was seated with his hands and feet shackled, wearing a gray suit, pink shirt, and black tie.

Prosecutors Present Videos and Evidence of Charlie Kirk’s Murder

One of the most sensitive moments of the hearing came during the presentation of video evidence related to the Charlie Kirk murder case.

According to reports presented in court, the footage showing the exact moment of the fatal shooting was viewed only by Judge Tony Graf and the attorneys representing both sides.

Charlie Kirk’s family—including his widow, Erika Kirk, and his parents—voluntarily left the courtroom before the footage was played after being warned about its graphic nature.

They later returned to observe the remainder of the proceedings.

During the playback of the video’s audio, multiple reports indicated that Judge Tony Graf visibly reacted upon hearing the fatal gunshot.

By contrast, Tyler Robinson reportedly showed no visible emotion throughout that portion of the hearing.

Prosecutors also called Utah State Bureau of Investigation agent David Hull as a witness.

Hull described several aspects of the investigation and presented multiple videos that prosecutors say directly connect Robinson to the crime.

Among the evidence is an alleged written confession that prosecutors say Robinson sent to Lance Twiggs, identified in court as his former partner, shortly after the killing.

Witnesses Describe the Scene as Defense Challenges the Evidence

Another key witness was Christopher Bagley, now an officer with the Spanish Fork Police Department.

Bagley testified that on September 10, 2025, he was working at Utah Valley University when he heard what he believed was a rifle shot coming from the area near the Losee Center.

He explained that his conclusion was based on the location of a firearm case found at the scene and the line of sight between the rooftop and the location where Charlie Kirk had been delivering his speech.

During the investigation, Bagley testified that he found a black-and-red screwdriver and markings he believed were consistent with the use of a sniper shooting pad.

He also reported discovering footprints in the grass and additional marks along the edge of the roof.

During cross-examination, however, the defense sought to challenge the reliability of that testimony.

Defense attorney Kathy Nester asked whether Bagley’s original report identified the direction from which the shot had been fired.

He answered that it did not.

Bagley also acknowledged that he did not know what later happened to the firearm case recovered at the scene.

The defense further objected to part of the prosecution’s video evidence

Specifically, attorneys challenged an edited surveillance video that included zoomed-in images and red circles highlighting certain movements.

Judge Tony Graf sustained the objection, ruling that the edited version had not been properly authenticated.

Prosecutors said they intend to introduce the original, unedited footage later in the proceedings.

Donald Trump Jr. Joins the Family as Proceedings Continue

Several prominent conservative figures attended the hearing.

Donald Trump Jr. arrived with his wife, Bettina, and spent much of the day seated alongside Charlie Kirk’s family.

Conservative commentators Jack Posobiec and Brandon Tatum were also present, sitting in the front rows with the victim’s relatives.

Meanwhile, Tyler Robinson’s parents sat several rows behind them with other members of the defendant’s family.

The preliminary hearing will continue over the coming days as prosecutors present additional evidence to the court.

Expected evidence includes further witness testimony, surveillance footage, forensic reports, and the autopsy report, which concluded that Charlie Kirk died from a gunshot wound to the neck and ruled the death a homicide.

Agent David Hull is expected to return to the witness stand during the next hearing as the court continues evaluating whether sufficient evidence exists to send the Charlie Kirk murder case to trial.
