Assets, Property, and Financial Requests

Martínez also requested alternating the children’s tax dependency starting in 2025.

He asked that both parents maintain life insurance policies naming the minors as irrevocable beneficiaries.

He added a request for an equitable distribution of assets and liabilities—but with a larger proportion in his favor due to alleged financial contributions.

One of the most controversial filings was the request that the court consider possible marital misconduct on Ana Patricia’s part.

Martínez argued that if any financial impact derived from an extramarital relationship is proven, he should receive a greater share of the assets.

He also requested several types of alimony in his favor, including compensatory, temporary, or lump-sum support.

Additionally, he requested that the presenter cover some or all of his legal expenses, or alternatively, that the court evaluate a claim of malicious litigation.

An Emergency Motion for Christmas

Adding to the dispute, Ana Patricia filed an emergency motion on November 13 to travel with her children to Mexico for Christmas.

According to the documents, the family alternates holidays between Mexico and the United States, and this year the celebration was scheduled with the Gámez family.

Martínez initially refused to sign the travel permit for the children to leave the country.

The authorization arrived days later, but under specific conditions imposed by him, such as maintaining phone contact and avoiding the publication of images of the children.
