The White House denied in court that Elon Musk is the legal head of the Department of Government Efficiency (DOGE)—an office created by President Donald Trump with the goal of cutting federal government spending.

In a document filed Monday with the federal court in the District of Columbia, White House Administration Director Joshua Fisher stated that Musk is neither the administrator nor an employee of the DOGE.

The White House clarified that Elon Musk is not employed by the DOGE and, therefore, has no formal authority to make governmental decisions.

Fisher explained in the court filing that Musk is a «special, non-career government official» and advises President Trump but does not have direct authority over government decisions.

This statement comes in response to a lawsuit filed by Democratic state attorneys, who accuse Trump of granting Musk «virtually unchecked authority» without congressional approval.

The document also contradicts previous statements made by Trump, Musk, and the DOGE, who had described Musk as the leader of efforts to cut bureaucracy and shrink federal agencies.

After winning the election, Trump announced the creation of the DOGE and placed Musk and Vivek Ramaswamy at the helm, although Ramaswamy later distanced himself from the organization.

Last week, Musk appeared in the Oval Office alongside Trump, defending the DOGE’s actions as «transparent» despite criticism from the opposition.

The DOGE and Musk have been responsible for the restructuring of agencies such as the United States Agency for International Development (USAID) and the Consumer Financial Protection Bureau (CFPB), which oversee Wall Street and protect consumers.

Musk’s influence within the administration has raised concerns, prompting a federal judge to block the DOGE’s access to the Treasury Department’s payment system.

The controversy surrounding Musk’s role in the DOGE reflects growing tension between the White House and government critics, who argue that delegating powers to private-sector figures could undermine oversight and accountability.

The lack of clarity on who truly leads the DOGE and the confusion over Musk’s authority raise further doubts about the extent of his influence within the administration.

Additionally, this situation highlights concerns about the future of departments affected by restructuring, as they could face significant cuts in both personnel and functions.

Meanwhile, state attorneys continue to push for greater transparency, demanding that the government provide more details on the DOGE’s structure and operations, ensuring that any government action complies with legal and constitutional regulations.
